Criminal Defense Law and Your Rights 

The Constitution of the United States enumerates specific amendments designed to protect the rights of those charged with a criminal offense.

The Bureau of Justice Statistics details one of such amendments: “The Sixth Amendment to the U.S. Constitution establishes the right to counsel in federal criminal prosecution. Through a series of landmark decisions by the U.S. Supreme Court, the right to counsel has been extended to all criminal prosecutions, state or federal, felony or misdemeanor, that carry a sentence of imprisonment.”

The “double jeopardy” clause written in the Fifth Amendment is equally important and states that an individual who has been tried and acquitted of a crime cannot again be charged with it again. The Fifth Amendment further adds: “…nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”
